Terms of Service
These Terms of Service ("Terms") govern your use of the websites, products, and services provided by Glyphora ("we", "our", "us"), including but not limited to Tutelync (tutelync.com) and any custom development services. By accessing or using our services, you agree to be bound by these Terms.
1. Services Overview
Glyphora provides:
- Tutelync: A cloud-based Software-as-a-Service (SaaS) platform for coaching center and tuition center management, including student management, attendance tracking, fee management, exam results, WhatsApp communication, and parent portals.
- LMS Development: Custom Learning Management System website and mobile app development services for educators and institutions.
- Custom EdTech Development: Bespoke software development services for the education sector.
2. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must be at least 18 years old to create an account.
- One coaching center may have one primary account with additional user accounts (teachers, staff) as per their subscription plan.
- You are responsible for all activities that occur under your account.
3. Subscription Plans & Billing
- Tutelync offers multiple subscription plans (Free, Starter, Growth, Pro) with varying features and limits.
- Paid subscriptions are billed monthly or annually through Razorpay.
- Subscription fees are charged in Indian Rupees (INR) and are inclusive of applicable taxes.
- Auto-renewal: Paid subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.
- We reserve the right to modify pricing with 30 days' advance notice to existing subscribers.
- Usage limits (number of students, batches, WhatsApp messages) are enforced as per the selected plan.
4. Acceptable Use
You agree NOT to:
- Use our services for any unlawful purpose or in violation of any applicable laws.
- Share, resell, or redistribute your account access to unauthorized parties.
- Attempt to reverse-engineer, decompile, or extract source code from our platforms.
- Upload malicious content, viruses, or harmful code.
- Send spam or unsolicited messages through our WhatsApp integration.
- Misrepresent your identity or coaching center information.
- Exceed the usage limits of your subscription plan through automated or bulk operations.
5. Data Ownership & Responsibilities
- Your Data: You retain full ownership of all data you enter into Tutelync (student records, attendance, fees, exam results). We do not claim any ownership of your content.
- Data Controller: As the coaching center owner, you are the "Data Controller" for student and parent data under applicable data protection laws. You are responsible for obtaining necessary consents from parents for data collection and WhatsApp communications.
- Data Export: You can export your data at any time through the platform's export features (CSV/PDF).
- Data Backup: We maintain regular backups of all data. However, we recommend you maintain your own records as well.
6. WhatsApp Communication
- WhatsApp notifications (attendance alerts, fee reminders, receipts, exam results) are sent on behalf of your coaching center through the official WhatsApp Business API.
- You are responsible for ensuring you have consent from parents/guardians to send them WhatsApp messages.
- WhatsApp message limits vary by subscription plan. Exceeding limits may require a plan upgrade.
- WhatsApp message delivery depends on Meta's WhatsApp Business API infrastructure. We do not guarantee delivery of every message.
7. Intellectual Property
- The Tutelync platform, Glyphora website, and all associated code, design, logos, and content are the intellectual property of Glyphora.
- Your subscription grants you a non-exclusive, non-transferable license to use the platform during your active subscription period.
- For custom LMS development projects: upon full payment, you receive ownership of the custom-built application as specified in the project agreement.
8. Service Availability
- We strive for 99.9% uptime but do not guarantee uninterrupted service.
- Scheduled maintenance will be communicated in advance via email or in-app notification.
- We are not liable for downtime caused by third-party services (Supabase, Vercel, WhatsApp API, Razorpay) or force majeure events.
9. Limitation of Liability
To the maximum extent permitted by Indian law:
- Glyphora shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
- Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
- We are not liable for any loss of data, revenue, or business opportunities resulting from service interruptions.
10. Termination
- You may cancel your subscription at any time through your account settings or by contacting us.
- We may suspend or terminate your account if you violate these Terms, with notice where reasonable.
- Upon termination, your data will be retained for 90 days to allow data export, after which it will be permanently deleted.
- Termination does not relieve you of any payment obligations incurred before termination.
11. Modifications to Terms
We may modify these Terms at any time. Significant changes will be communicated via email to registered users at least 15 days before they take effect. Continued use of our services after changes constitutes acceptance.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Wayanad, Kerala, India. Before initiating legal proceedings, both parties agree to attempt good-faith resolution through direct communication.
